1. Scope of Application These General Terms and Conditions (GTC/AGB) apply to all orders placed by consumers via the online shop of Viktor Korol, Kirchgasse 2, 53489 Sinzig (hereinafter referred to as the "Seller").
2. Conclusion of Contract and Storage of Contract Text (1) Product presentations in the online shop do not constitute a legally binding offer but an out-of-binding online catalog. (2) By clicking the order button, the customer places a binding purchase offer. (3) The Seller shall confirm receipt of the order immediately by an automated email. This confirmation does not yet constitute acceptance of the purchase offer. (4) The contract is only concluded when the Seller accepts the customer's offer by sending a separate order confirmation and a payment link via email. (5) The contract text is stored by the Seller. The customer receives the order data by email. The contract languages are German or English.
3. Prices and Shipping Costs (1) The prices stated are final prices. In accordance with § 19 UStG (German VAT Act), no value-added tax (VAT) is charged or displayed (Small Business Status). (2) Shipping costs are additional: Germany flat rate 14.00 EUR. For other EU countries, shipping is calculated individually and communicated to the customer before the contract is concluded.
4. Payment Conditions and Reservation (1) Payment is made via an individual payment link (e.g., PayPal or Stripe), which the customer receives after the availability of the goods has been verified. (2) The ordered goods will be reserved for the customer for a maximum of 3 business days from the time the payment link is sent. If no payment is received within this period, the Seller reserves the right to cancel the reservation and sell the goods elsewhere. (3) Shipping takes place only after full payment has been received.
5. Retention of Title The goods remain the property of the Seller until full payment has been made.
6. Damage in Transit (1) If goods are delivered with obvious damage caused in transit, the customer is requested to complain about such defects to the delivery agent and contact the Seller. (2) Failure to make a complaint has no effect on the customer's legal warranty rights but helps the Seller to assert claims against the carrier.
7. Warranty The statutory liability for defects of the Federal Republic of Germany applies.
8. Online Dispute Resolution (ODR Platform) The European Commission provides a platform for online dispute resolution (ODR), which can be found at https://ec.europa.eu/consumers/odr/. We are neither obliged nor willing to participate in a dispute resolution procedure before a consumer arbitration board.
9. Final Provisions German law shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
